            Occasionally conflicts arise among co-owners of property which must be resolved either by negotiation or by court proceedings (“partition”). We try to resolve this through negotiation at minimum expense to you, but failing that we will aggressively pursue a resolution in court.

In Louisiana “succession” means the process by which our courts give legal effect to the transmission of property ownership after death.  At Tillery & Tillery we have years of experience helping our clients assure that their wishes are carried out with the least risk of unnecessary delay, expense or conflict. In most cases this involves proper drafting and execution of a testament or will and other important documents, but we will discuss and advise you about all options appropriate for you.
            Simple successions can be resolved quickly without administration, the process by which assets are identified and debts paid before heirs are placed in legal possession. When administration is necessary we work with and advise the executors/administrators throughout the process to ensure proper handling and resolution.
According to historical records there have been court disputes in Louisiana over wills and successions as early as 1724.   An heir can challenge a will but the challenge can succeed only if the will was not drafted or executed properly or the deceased lacked the requisite mental capacity or was unduly influenced.  At Tillery & Tillery we have extensive experience in disputed succession matters including will contests, challenges to the performance of executors/administrators and disputed property issues. Our philosophy is to seek prompt amicable resolution, but if that is not possible, we will aggressively assert our client’s claims in court and fight for an expeditious conclusion.
